  1. NHSC Consent for Use of Personal Information

    I authorize Ontario Soccer to collect and use personal information about me/ my child/ward, including name, address, email, telephone number, cell phone number, sex, age, date of birth, medical history (optional) and any other additional information required by the Club for its own needs for the following purposes:
    a) Receiving communications from Ontario Soccer;
    b) Receiving information from The Ontario Soccer's sponsors;
    c) Ensuring appropriate age group and category;
    d) Determining eligibility;
    e) Media relations and publishing sports information;
    f) In the case of medical emergencies;
    g) Determining membership demographics and program wants and needs;
    h) Player Identification/Recruitment; and
    i) Posting rosters, statistics, images and results on website of Ontario Soccer/NHSC.
    j) disclosure of my or my child/ward’s name and address to the City of Sault Ste. Marie for the purpose of securing the soccer facilities and no other purpose.
    I also authorize Ontario Soccer to disclose my child’s/ward’s personal Information to the Canada Soccer, NHSC, Leagues and Tournament Host Organizations for the purpose of annual demographic reporting, registration, posting competition information, organizational needs and to communicate with registrants about soccer programs, events and activities; and third party agent to solely facilitate direct mailings from Ontario Soccer.
    I consent to Ontario Soccer /NHSC to take photographs, videotape, or digital recordings of me or my child/ward
    and to use these in any and all media, including Ontario Soccer's/NHSC's website.

    Acceptance of Terms and Conditions
    In consideration of the acceptance of my membership in Ontario Soccer, I, the participant, parent/guardian if under 18, agree as follows:
    1. I understand that I cannot play in any sanctioned soccer game until this registration form has been validated and the registration data has been entered in Ontario Soccer’s computerized registration system.
    2. I have reviewed the waiver/participation agreement and my signature affixed hereto indicates my agreement with such waiver/ participation agreement.
    3. To abide by the published rules of Ontario Soccer, The Sault Amateur Soccer Association, NHSC bylaws, policies, rules and regulations and agree to abide by them and to be bound by them.
    4. I accept sole responsibility for my/child/ward personal possessions and athletic equipment.
    5. I accept all liability for any damage to the playing equipment caused by my careless, negligent and/or improper handling.
    By signing and dating below, you agree that you are the parent or legal guardian of the player being registered and to be bound by this Legal Agreement even if you have not read the agreement.

    Waiver/Participation Agreement
    In Consideration of allowing my minor child/ward to participate in the programs, activities and events of the Ontario Soccer,
    I ASSURE TO YOU THAT:
    1. I am the parent/guardian of the named participant having full legal responsibility for decisions regarding the above named participant,
    2. I believe that my minor/ward is physically, emotionally and mentally able to participate in the programs, activities and events of the Ontario Soccer.
    3. I hereby acknowledge that I am aware of the risks and hazards associated with or related to soccer. The risks and hazards include, but are not limited to injuries from:
    - executing strenuous and demanding physical techniques in soccer;
    - dryland training including weights, running, and massage;
    - grass, turf and other surfaces including bacterial infections and rashes;
    - falls to the ground due to uneven or irregular terrain or surfaces;
    - collisions with walls and soccer equipment;
    - failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment.
    - Spinal cord injuries which may render me permanently paralyzed;
    - contact, colliding or being struck by other participants, spectators, equipment or vehicles;
    - vigorous physical exertion and strenuous cardiovascular workouts;
    - exerting and stretching various muscle groups; and
    - Travel to and from competitive events and associated non-competitive events which are an integral part of the organization’s activities.
    4. Furthermore, I am aware that my child/ward may:
    - Sustain injuries in soccer that can be severe;
    - Come into close contact with other participants, including the possibility of accidental and unexpected contact,
    - Experience anxiety while challenging himself/herself during the activities;
    - Risk of injury is reduced if he/she follows all rules established for participation; and
    - Risk of injury increases as he/she become fatigued.
    I UNDERSTAND AND AGREE, on behalf of myself, my heirs, assigns, personal representatives and next of kin that my signing of this document constitutes:
    5. I am registering my child/ward willingly and my child/ward is participating voluntarily in these activities, events and programs.
    6. I agree that there are risks in soccer as described above and my child/ward will be exposed to these risks and hazards.
    7. I agree to accept them and be responsible for any injury or other loss which my child/ward might receive while participating in these events, activities and programs.
    8. If something happens to my child/ward, I release the organizers of responsibility for any claims, demands, actions and costs which might arise out of my child/ward’s participation. I understand “organizers” to mean: Ontario Soccer, District Association, Leagues, Clubs and its directors, officers, members, employees, volunteers, officials, participants, agents, sponsors, owners/operators of the facility, and representatives.

  2. ONTARIO SOCCER

    INFORMED CONSENT AND ASSUMPTION OF RISK AGREEMENT

    (To be executed by Participants under the age of majority)

    WARNING! By agreeing to this document, you will assume certain risk and responsibilities.  Please read carefully!

      

    1. This is a binding legal Clarify any questions or concerns before signing. As a Participant in activities, programs, classes, services provided and events sponsored or organized by Ontario Soccer and its affiliated districts, leagues, clubs and teams (collectively the “Organization”) and the sport of soccer, including but not limited to: games, tournaments, practices, training, personal training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientational or instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the “Activities”), the undersigned being the Participant and Participant’s Parent/Guardian (collectively the “Parties”) acknowledges and agrees to the following terms outlined in this agreement:

     

    1. I am the Parent/Guardian of the Participant and have full legal responsibility for the decisions of the Participant.

     

    Description of Risks

    1. The Parties understand and acknowledge that:
      1. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life;
      2. The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming;
      3. The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of the Participant’s fitness or abilities, may give incomplete warnings or instructions, may misjudge weather or environmental conditions, and the equipment being used might malfunction; and
      4. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that the Participant will not become infected with COVID-19.  Further, attending the Activities could increase your risk of contracting COVID-19. 

     

    1. The Participant is participating voluntarily in the Activities. In consideration of that participation, the Parties hereby acknowledge that they are aware of the risks, dangers and hazards and may be exposed to such risks, dangers and hazards. The risks, dangers and hazards include, but are not limited to:
      1. Contracting COVID-19 or any other contagious disease;
      2. Executing strenuous and demanding physical techniques;
      3. Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements;
      4. Exerting and stretching various muscle groups;
      5. The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;
      6. Spinal cord injuries which may render the Participant permanently paralyzed;
      7. Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of the Participant’s body or to the Participant’s general health and well-being;
      8. Abrasions, sprains, strains, fractures, or dislocations;
      9. Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma;
      10. Physical contact with other participants, spectators, equipment, and hazards;
      11. Not wearing appropriate safety or protective equipment, such a helmet;
      12. Failure to act safely or within the Participant’s ability or within designated areas;
      13. Grass, turf, and other surfaces including bacterial infections and rashes;
      14. Collisions with fences, poles, stands, and soccer equipment;
      15. Negligence of other persons, including other spectators, participants, or employees;
      16. Weather conditions; and
      17. Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities

    Terms

    1. In consideration of the Organization allowing the Participant to participate in the Activities, the Parties agree:
      1. That the Participant’s mental and physical condition is appropriate to participate in the Activities;
      2. That when the Participant practices or train in his or her own space, the Parties are responsible for the Participant’s surroundings and the location and equipment that is selected for the Participant;
      3. To comply with the rules and regulations for participation in the Activities;
      4. To comply with the rules of the facility or equipment;
      5. That if the Participant observes an unusual significant hazard or risk, the Participant will remove themselves from participation and bring such to the attention of an Organization representative immediately;
      6. The risks associated with the Activities are increased when the Participant is impaired and the Participant agrees not to participate if impaired in any way;
      7. That it is their sole responsibility to assess whether any Activities are too difficult for the Participant. By the Participant commencing an Activity, they acknowledge and accept the suitability and conditions of the Activity;
      8. That they are responsible for the choice of the Participant’s protective equipment and the secure fitting of the protective equipment;
      9. That COVID-19 is contagious in nature and the Participant may be exposed to or infected by COVID-19 and such exposure may result in personal injury, illness, permanent disability or death and voluntarily agree to assume all of the foregoing risks.

     

    1. In consideration of the Organization allowing the Participant to participate, the Parties agree:
      1. That the Parties are not relying on any oral or written statements made by the Organization or their agents, whether in brochure or advertisement or in individual conversations, to agree to be involved in the Activities; and
      2. That the Organization is not responsible or liable for any damage to the Participant’s vehicle, property, or equipment that may occur as a result of the Activities.

       General

    1. The Parties agree that in the event that they file a lawsuit against the Organization, they agree to do so solely in the province of Ontario, Canada and they further agree that the substantive law of Ontario will apply without regard to conflict of law rules.

     

    1. The Parties expressly agree that this Agreement is intended to be as broad and inclusive as is permitted by law and that if any of its provisions are held to be invalid, the balance shall, notwithstanding, continue in full legal force and effect.

     

    Acknowledgement

    1. The Parties acknowledge that they have read this agreement and understand it, that they have executed this agreement voluntarily, and that this Agreement is to be binding upon themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators and legal or personal representatives.
  3.                                                                            APPENDIX A
                       WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
                    ASSUMPTION OF RISK/WAIVER OF LIABILITY/INDEMNIFICATION AGREEMENT


    Please read this document (the “Waiver”) carefully, as it affects your future legal rights. Please provide your initials on each page after reading. By signing below, you (on behalf of yourself or your minor child/ward and any personal representatives, assigns, heirs and next of kin) acknowledge, agree and represent that you have carefully read and fully understood the Waiver and agreed to its terms. Each individual attending the City Facility below must complete and sign the Waiver. A parent/guardian of a minor Attendee must complete and sign the Waiver on behalf of the minor Attendee. This Waiver must be carefully read and signed in consideration of the opportunity of being a willing Attendee permitted to enter the Premises. As used herein, the term “Releasees” is defined to include the following: The Corporation of the City of Sault Ste. Marie, their respective councilors, officials, officers, directors, employees, consultants, agents, successors, contractors, employees and assigns.

                    BETWEEN: NHSC AND THE CORPORATION OF THE CITY OF SAULT STE. MARIE (CITY)

    In consideration of ____________________(INSERT NAME) being allowed to participate in NHSC at the City Facility known as the Northern Community Center, Sault Ste. Marie, Ontario and related events and activities, under all City facility use Permits for 2022 (hereinafter referred to as the “Activities”) the undersigned acknowledges,appreciates and agrees as follows:

    1. I expressly acknowledge and agree that my attendance at the City Facility and participation in the Activities may involve the risk of serious injury and/or death and/or property damage. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19.

    2. I am fully aware of the risks and hazards inherent in my attendance at the City Facility and participation in the Activities and I voluntarily, knowingly and freely assume all risks associated with participating in the Activities at the City Facility, including but not limited to my own actions or inactions (or the actions or inactions of my minor child/ward), the actions or inactions of others (including but not limited to Northern Heights Soccer Club or their staff and/or volunteers, falls, injuries, illnesses, infectious diseases including but not limited to COVID-19, death, and navigating any and all obstacles and any defects of the City Facility.

    3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM
    THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.

    4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS THE RELEASEES WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or
    loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR
    OTHERWISE, to the fullest extent permitted by law.

    I have read this document in its entiety and fully understand its terms. I understand that I am giving up substantial legal rights by signing below, including the right to sue the Releasees. I acknowledge that I am signing this agreement freely and voluntarily and intend my signature to be a waiver and complete and unconditional release of all liability due to thenegligence of the Releasees or, the inherent risks of participating in the Activities

    FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF SIGNING) = This is to certify that
    I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release providedabove for all the RELEASEES and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the RELEASEES for all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the extent provided by law. I HAVE LEGAL AUTHORITY TO ENTER THIS AGREEMENT ON BEHALF OF THE MINOR.

    Pursuant to Ontario’s Electronic Commerce Act, 2000, this Waiver may be executed electronically and in several counterparts via facsimile or electronicsignature or original signature, each of which so executed shall be deemed to be an original, and such counterparts together shall constitute but oneand the same document.

  4. Rowan’s Law:

    Under Rowan's Law, before any player can be registered with SASA and Ontario Soccer, the player, and the parent or legal guardian of the player if the player is under 18 years of age, must review one of the Concussion Education Resources provided by the Province of Ontario.  Links to these resources are provided here and will open in a separate window:

    Rowan's Law Acknowledgement:

    I hereby confirm that the player being registered to participate in soccer activities with SASA and Ontario Soccer, and the parent or legal guardian of the player being registered if the player is under 18 years of age, have reviewed one of the concussion education resources provided by the Province of Ontario as referenced above.  I / we further acknowledge understanding the nature and risk of concussion and head injury to athletes, including the risks of continuing to play after a concussion or head injury is suspected.
